Who am I
The elifstudios website, hereinafter the “Site” is edited and operated by el/if., a sole proprietorship under the SIREN number 885 121 772, having its registered office at 38 rue Monplaisir at 31400 Toulouse, and whose intra-community VAT number is FR28885121772.
The Site is accessible in English.
Article 1: PURPOSE AND SCOPE OF THE TERMS OF SALES
These terms of sales apply to all sales concluded between el/if. and any non-trader natural person aged at least 18 years old and having the legal capacity to contract (hereinafter the "Customer"), relating to products presented on the Site (hereinafter the "Products").
The Customer, prior to her/his order, declares that the purchase of products on the Website is not directly related to her/his professional activity and is limited to strictly personal use.
Any order for a Product offered for sale on the Site implies full and complete acceptance, without restriction or reservation, of these terms of sales, which the Customer acknowledges having read prior to any payment. Any contrary condition imposed by the Customer is unenforceable against el/if. in the absence of express acceptance on her/his part materialized in writing.
el/if. reserves the right to modify the terms of sales at any time. In the event of a modification, the terms of sales in force on the day the order is placed will be applied to this order.
The texts, photos, logos, and all the content of the Site may be subject to change, modification at any time without notice.
ARTICLE 2: INFORMATION RELATING TO THE PRODUCTS
The Products presented on the Site are available for sale. However, due to the small number of items produced, it cannot be excluded that the product becomes unavailable during the order.
el/if. reserves for itself the right to change the prices, quantity, description, category and assortment of items offered for sale on its Site at any time.
The essential characteristics of the Products are described with the greatest possible accuracy.
In this regard, the Customer acknowledges and accepts that the Products are made from recycled materials and second-hand clothing that may contain original defects.
A description of each Product is made with as much precision as possible but it cannot claim to be exhaustive on all the defects that a creation may present (tearing, pilling, discoloration, tightness, etc.).
The illustrations and photographs on the Site faithfully reproduce the Products offered.
However, the Customer acknowledges and accepts that the photographs of the Products may not reflect all the imperfections of each Product, with in particular certain nuances of colour alterations.
For any questions concerning the Products, the buyer can send a message via a contact form in the "contact" section of the Site.
The Products are published in standard measurement sizes and can in no way be made-to-measure. When a product is made-to-measure it's well specified in the e-shop with no misunderstanding possible.
ARTICLE 3: PRICE OF PRODUCTS
The prices indicated on the Site are expressed in euros and include all taxes, but do not include shipping costs or customs duties. They take into account the applicable VAT and any reductions applicable on the day of the order.
The shipping costs (delivery, packaging and preparation of the package according to the amounts in force) are specified before validation of the order.
In the event of delivery abroad, the Customer undertakes to pay the customs duties and other taxes related to the importation of the Products into the country of the place of delivery and declares to do so. The Customer wishing to be delivered to a country outside the European Union therefore accepts without reservation having to pay in addition to the price of the Products and the delivery costs, customs fees and duties. Customs charges and duties are applicable to all orders shipped to a country outside the European Union and are not included in the price paid at the time of the order. They are fully the responsibility of the buyer and must be paid upon receipt of the package to the carrier.
If the Customer does not pay the customs charges upon receipt, el/if. will not accept the return package and will not make any refund.
el/if. reserves the right to modify the prices of its Products at any time, it being understood that the validation of an order constituting a sales contract commits the parties to the price and the item sold. A price cannot therefore be modified once the Customer's order has been validated.
The price indicated at the time of confirmation of the order is the price, all taxes included and including the amount of delivery costs calculated by the carrier (DHL or COLISSIMO).
Despite all our attention, some prices may show an error. If an order was registered with this pricing error, el/if. reserves the right and the choice to cancel the order, which will result in the buyer's refund.
ARTICLE 4: THE ORDER
In the event of force majeure, the company el/if. may suspend its delivery obligations, the buyer will then be informed within 7 days, if nothing changes within 15 days the order will then be cancelled and the buyer refunded.
To validly place an order, the Customer must identify herself/himself by entering a valid email address, a valid phone number and a valid address of which she/he certifies to be the holder.
Once her/his cart has been validated, the Customer must indicate a delivery address.
The Customer has the possibility to check the details of the order (Products, quantities, sizes, prices and delivery costs) and the information entered concerning him/her (email address, delivery address, billing address) in order to correct any errors, before confirming her/his order.
The validation of the order by the Customer constitutes the Customer's agreement on the characteristics of the sale, both on quantities, pricing (including delivery costs), and on the nature of the Products. No order modification can be made from this validation.
The validation of the order commits the Customer and entails the obligation to pay.
The Customer acknowledges and accepts that the deadline commitments are only applicable from the effective receipt of payment by el/if.
The Products ordered remain the property of el/if. until full payment of the amounts due.
The Customer will receive by email an acknowledgment of receipt of the order by el/if.
This acknowledgment of receipt confirms that the order has been taken into account by el/if. and not that the product ordered is available.
el/if. undertakes to honor orders received on the Site only within the limits of available stocks of the Products. The Customer is informed in this regard that no pre-reservation of the Products is guaranteed during the selection of the Products and the placing of the order (in particular in the event of prolonged inactivity during the connection), so that a out of stock may occur at the time of order validation.
In case of unavailability of the ordered Product, the Customer is informed without delay. In this case, the order will be cancelled and no debit will be made, and if the latter has already occurred, a refund will be made without delay.
el/if. reserves the right to cancel any order which could suggest that it is made for economic or professional purposes.
Orders are archived by el/if. and can be communicated at the Customer's simple request by email.
ARTICLE 5 - TERMS OF PAYMENT
Payment for the order is made by PAYPAL which ensures the security of the transaction: the Customer is automatically redirected to the PayPal site, which allows her/him to pay with her/his PayPal account. The order is recorded when payment is validated on the PayPal site and PayPal notifies el/if.
el/if reserves the right to suspend or cancel any order in the event of non-payment thereof or payment incident.
ARTICLE 6 - DELIVERY AND RECEPTION
The Products are delivered by DHL or COLISSIMO Companies depending on your choice during your purchase. The delivery address, the email and the phone number is that indicated by the buyer, in the event of an error in filling in the information, el/if. is not responsible.
el/if. delivers all over the world using DHL company and in Europe using DHL and COLISSIMO companies. Please note that COLISSIMO is less expensive because it's a standard postal service. I need to secure your parcel to track the process shipping. Unfortunately the COLISSIMO company tracks the parcel only in the European Union countries (+UK, Norway, Iceland, Switzerland). For this reason I deliver only in those countries with COLISSIMO and not all around the world.
Shipping costs are not included in the item price, you pay them at the end of the order process in the e-shop with the total price. Shipping costs depend on your localization and on the weight of the package.
el/if. undertakes to return the Products which are in stock on the day of the order to the carrier (DHL or COLISSIMO) no later than 72 working hours after validation of the order by the Customer.You should normally be delivered within a maximum of 20 working days depending on your area of residence and the company you have chosen.
The Customer will be informed of the shipment of her/his package and of the practical arrangements for tracking the package.
If the Customer is absent when the package is delivered, it is the Customer's duty to turn to DHL platform customer service to see if a second delivery can be planned. If the customer selects the COLISSIMO services, in case of absence, you have to go as soon as possible to your post office (within 10 days) to pick up the parcel, thanks to the slip puts in your letter box. In the event of a return of the item, the Customer will not be reimbursed for the first and second delivery costs.
For any delay, delivery problem, damage or loss of the package and items, the Customer should contact the transporter with her/his tracking number. We invite all our Customers to protect themselves by taking out the DHL transport guarantee (Formula "DHL Express with insurance" during your purchase).
Upon receipt of the Products, the Customer is invited to check the condition of the packaging and the integrity of the Products. If the package is damaged following transport (already opened, missing Products), we ask you to refuse the package. and to make any reservations / complaints on the carrier's delivery note.
el/if. in no way guarantees damage caused to the package and the Product during transport and cannot reimburse the Product in the event of a dispute with the carrier.
In the event of delivery abroad, the Customer undertakes to pay customs duties and other taxes related to the importation of the Products into the country of the place of delivery. If the customer refuses or abandons the package without paying the customs fees we will not refund the order.
ARTICLE 7: EXCHANGE AND REFUND
el/if. is a small, very young company which has limited capacity to take back items. So please note that most of the pieces are made from very delicate materials like tights and vintage items. You should know that there may be some imperfections (color defects related to the origin of the garment, textiles weakened by time, pantyhose-based materials can be frayed and very fragile ...). The sizes indicated are standard sizes and will never be made to measure.
The flaws of an upcycled vintage piece are also part of the identity of this piece and of el/if.

Made-to-measure products are neither refundable nor exchangeable.
Products established on the Site may be subject to withdrawal.
The Customer has a period of fourteen days from the day the Customer takes physical possession of the product, to exercise her/his right of withdrawal, without having to justify her/his decision.
The Customer must inform within the aforementioned period el/if., by sending her her/his decision of withdrawal by means of an unambiguous declaration by completing the downloadable return form with this LINK. The Customer has to send the form by email at email@example.com
The Customer must return the ordered Products, at her/his exclusive expense, packed in the original packaging, with all the elements that were sent during shipment in a parcel adapted in size, to el/if. 16 rue de Metz - 31000 TOULOUSE - France, without undue delay and at the latest, within fourteen days of sending the withdrawal form. Beyond this period, no reimbursement will be made.
A ribbon-shaped tag surrounds the product and in no way prevents the product from being tried on. It is mentioned on the tag "ATTENTION! DON’T REMOVE ME UNLESS SATISFIED, OTHERWISE NO RETURN WILL BE POSSIBLE IF THIS TAG IS DAMAGED"
Returned products must be
- not damaged
- Not cleaned
- the TAG tape surrounding the product must be in place and not damaged
The customer acknowledges and accepts that the first shipping cost to receive the Products and the final shipping cost to return the products remains her/his responsibility, and that her/his liability may be incurred in the event of damage to the Products. The return of products is made at the expense and risk of the Customer. el/if. recommends returning the Products via DHL.
el/if. will reimburse the item upon receipt of the products.
Only the price of the items will be refund, not the shipping costs and the customs fees.
The reimbursement of returned products, subject to compliance with the above-mentioned conditions, as well as the standard delivery costs of shipping the latter when the entire order is returned, will be made using the same means of payment as the one used by the customer when ordering.
Apart from exercising the right of withdrawal, no exchange or refund is allowed.
ARTICLE 8: RESPONSIBILITIES
The Products offered on the Site comply with current French legislation. All Products benefit from the legal regime of the guarantee of conformity provided for in articles L217-4 and following of the Consumer Code, as well as the guarantee against hidden defects of articles 1641 and following of the Civil Code.
el/if cannot be held liable in the event of non-compliance with the legislation of the country where the Products are delivered. It is the Customer's responsibility to check with local authorities the possibilities of importing or using the Products she/he intends to order.
el/if. cannot be held liable in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable fact of a third party to the contract or to a case of force majeure as defined by French case law.
el/if. cannot be held liable in the event of an error indicated by the Customer relating to her/his email address or her/his delivery address. In the event of an error in the delivery address, any re-shipment costs will be borne by the Customer.
el/if. cannot be held responsible for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses. In this regard, the Customer is personally responsible for setting up the IT and telecommunications resources allowing access to the Site, for which she/he retains all costs.
ARTICLE 9: INTELLECTUAL PROPERTY
All elements of the Site, whether textual, visual or audio, including the underlying architecture, are protected by the provisions of the Intellectual Property Code. The brands, logos, designs and models appearing on the Site are the exclusive property of el/if.
Any reproduction, even partial of the Site, of the texts, images and photographs presented therein is prohibited. The content of the Site, in whole or in part, may not be reproduced, downloaded or otherwise manipulated without prior authorization, with the exception of a copy for private and non-commercial use.
Any hypertext link to the home page of the Website or to certain pages, texts, videos or images of the Site must be the subject of a prior request to el/if.
The deep linking technique is prohibited, that is to say that the pages of the Site must not be nested within the pages of another website.
ARTICLE 10: PERSONAL DATA AND COOKIES
el/if. protects the privacy of individuals and the confidentiality of personal data, and is committed to providing them with the best level of protection.
ARTICLE 11: FINAL PROVISIONS
The General Conditions are subject to French law. In the absence of amicable settlement, the disputes will, in all cases and regardless of the number of parties to the dispute, the exclusive jurisdiction of the French courts.
The fact that el/if. does not invoke a breach of any of the obligations payable by the Customer, governed by these terms of sales, cannot be interpreted as a waiver for the future of the obligation involved, or the right for the Customer to subsequently invoke this failure.
If one or more stipulations of these terms of sales are held to be invalid or declared null or unwritten in application of a law, a regulation or following a final decision of a competent court, the others stipulations will retain all their scope and force.
